After a recent visit to the offices of the MIOSA we have
adapted our Specific Conditions OTP some more.
If a dealership sells a vehicle under Specific Conditions
the following should be in place:
- The customer must be aware of the fact that a specific
vehicle is offered in a specific condition before the
negotiations to buy the vehicle takes place.
- The burden of proof would be on the dealership if
a dispute is lodged with the MIOSA to prove the above.
This can be achieved by the following:
- If the vehicle is advertised it should be noted
on the advertisement that specific conditions for the
sale exists.
- The dealership can have visible information boards
indicating that the vehicles in a particular section
is sold subject to specific conditions.
- Clearly mark the vehicle as being sold subject to
specific conditions.
- Keep a signed copy of the displayed information indicating that the sale is subject to specific conditions with your specific conditions OTP.
- Ensure that the consumer signs the OTP when it is completed and initial next to any changes on the document. Provide the consumer with a copy of the OTP.
