SuperSpark looks into transactions with other dealerships

Peter from Pretoria wants to know whether he has any protection under the CPA if he buys from a another dealership and the vehicle is not in the condition as presented.

He wrote,

“We bought a vehicle from a another dealership in Bloemfontein, that I sourced on an auction website.

On delivery of the vehicle it was obvious that the vehicle was in a major accident and repairs were not done according to specifications.

The website administrators state on the website that they don’t take responsibility for the description of the vehicles on auction as that lies with the seller. We paid the seller directly.

Do I have any recourse under the Consumer Protection Act?”

SuperSpark replies:

Dear Peter,

The Act was written to protect the consumer purchasing goods or services from a registered supplier and does not cover transactions between registered suppliers or transactions between private individuals.

You will have to open a civil case against the seller, as you unfortunately do not have any recourse under the Consumer Protection Act.
